Maternity Laws in India-
What is Maternity Law in India?
Maternity laws in India are designed to protect the health and rights of women during pregnancy and childbirth, ensuring they have the support needed to balance work and family responsibilities. The Maternity Benefit Act, 1961 is the primary legislation that governs maternity leave and benefits for women employees working in establishments with 10 or more employees.
These laws guarantee certain rights such as paid leave, healthcare benefits, and job protection for women during and after pregnancy. The aim is to ensure that women are not discriminated against and can maintain both their professional and personal well-being.
Key Provisions of Maternity Benefit Act, 1961
1. Maternity Leave Duration
Under the Maternity Benefit Act, a woman employee is entitled to 26 weeks of paid maternity leave. This is applicable to women who have worked with the same employer for at least 80 days in the 12 months preceding the date of delivery.
🔹 Key Points:
The 26-week maternity leave can be availed before or after the delivery.
Women can take up to 8 weeks of leave before the expected delivery date and the remaining leave after delivery.
2. Leave for Miscarriage or Medical Termination of Pregnancy
Women are entitled to 6 weeks of paid leave in the case of a miscarriage or medical termination of pregnancy. This leave can be availed immediately after the miscarriage.
🔹 Key Points:
The employee must provide a medical certificate for the miscarriage.
Leave is fully paid during this time.
3. Adoption and Surrogacy Leave
The Act also covers adoptive mothers and women who become mothers through surrogacy. They are entitled to 12 weeks of maternity leave.
🔹 Key Points:
Adoptive mothers are entitled to leave for 12 weeks from the date the child is handed over to the mother.
Surrogate mothers are also entitled to 12 weeks of paid leave from the date of the child’s birth.
4. Protection Against Termination
The Act protects women from termination during their maternity leave and up to a certain period after their return. Employers are not allowed to dismiss or reduce the salary of a woman during her maternity leave.
🔹 Key Points:
Job protection: A woman cannot be terminated during maternity leave.
Return to Work: She is entitled to return to the same position or a similar role post her leave.
5. Maternity Benefits during Employment
Women are entitled to maternity benefits which include their full salary during the leave period. The employer is legally required to pay this amount, which is generally the average salary received during the last three months of employment before taking leave.
🔹 Key Points:
Employers must maintain full wages during maternity leave.
Maternity benefits are applicable for employees who have worked for more than 80 days in the last 12 months.
6. Crèche Facilities and Other Support
Employers with more than 50 employees are required to provide crèche facilities for the children of female employees. Women are entitled to take breaks during work hours to visit the crèche, ensuring that their children are well taken care of while they are working.
🔹 Key Points:
The crèche must be within a reasonable distance from the workplace.
Employers are required to ensure that working mothers have access to these facilities.
7. Employer’s Obligations
The employer’s responsibilities under the Maternity Benefit Act include:
Paying maternity benefits to eligible employees.
Reinstating the employee to her previous position (or an equivalent position) upon return from leave.
Providing crèche facilities if required.
What are the Rights of a Working Mother?
1. Right to Maternity Leave
As per the Maternity Benefit Act, women workers are entitled to 26 weeks of paid maternity leave (with conditions). This is one of the most important rights for women in the workforce.
2. Right to Non-Discrimination
Employers cannot discriminate against employees for being pregnant or availing maternity leave. A pregnant woman is entitled to equal pay for equal work and the same opportunities as her male counterparts.
3. Right to Job Security
A woman employee’s job cannot be terminated during her maternity leave, and she must be reinstated to her original or equivalent position after the leave period is over.
4. Right to Health and Safety
Maternity laws ensure that a woman’s health is a priority, and employers must ensure that working conditions do not endanger the health of a pregnant woman.
5. Right to Nursing Breaks
The law also allows a woman who has returned to work after maternity leave to take nursing breaks for her child. This break typically lasts for 15 minutes for every 3 hours of work.
Common Maternity Law Disputes in India
1. Denial of Maternity Leave
Issue: Some employers may not be aware of their obligations or may not grant maternity leave as required by law.
Solution: Women can seek legal recourse to enforce their rights under the Maternity Benefit Act.
2. Termination During Maternity Leave
Issue: Some employers may attempt to terminate employees during or immediately after maternity leave.
Solution: The law provides for job protection, and any termination is illegal if it happens during the maternity leave period.
3. Unpaid Maternity Benefits

Solution: Women workers can approach the Labour Commissioner for legal redress and to claim their unpaid maternity benefits.
