Statutory Notes on Section 34 CPC Interest in India
Under Section 34 of the Code of Civil Procedure, 1908 (CPC), the court may award interest from the date of the suit to the date of decree at such rate as the court deems reasonable. Further interest from decree to payment is generally capped at 6% per annum for non-commercial transactions; for commercial transactions, the rate may exceed 6% based on contractual terms or banking rates.
